This Policy (together with any other documents referred to in it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data.

Tsavo Trust delivers its work in partnership with a wide range of organisations, and this sometimes involves sharing personal data. Our partners include Kenyan authorities such as the Kenya Wildlife Service (KWS), the Wildlife Research and Training Institute (WRTI) and county governments; conservation and community partners; and a broad base of donors, funders and fundraising partners in Kenya and internationally. Further detail on who we share information with, and why, is set out in the section “Do we share your information with anyone else?” below. One such fundraising partner is the Wildlife Conservation Network (WCN), a United States-based 501(c)(3) non-profit organisation (tax exempt ID #30-0108469), through which US-based donors can support Tsavo Trust. We share data with WCN in order to receive donations from supporters based in the USA, and to provide those supporters with information about our activities.

This website is not intended for use by children under the age of eighteen (18) years. Where necessary we will require parental or guardian consent to process the personal data of children, in line with the Children Act, 2022. Where we photograph or film individuals in the communities we work with, we seek their informed consent before using those images in our communications, and we obtain parental, guardian or school consent before using images of children.

What information do we collect?

We collect personal data as defined under the Kenya Data Protection Act, 2019 (‘personal information’). This may include information about:

• Service users and beneficiaries
• Donors and supporters
• Trustees and members of our Board
• Staff, contractors and service providers
• Media contacts
• Donation history
• Correspondence with us
• Information about the level of support that might be appropriate to ask you for

The personal information we collect may include name, date of birth, email address, postal address, photographs, payment details and telephone numbers.

How do we collect information?

If you are an employee, contractor or service provider to Tsavo Trust, we will collect information in line with your contract of employment or engagement.

If you have made a financial donation to or otherwise supported Tsavo Trust, we will collect information about your donation history.

We may collect information available in the public domain, for example newspaper or online media items, publicly available posts on LinkedIn or other social media, or listings held by the Kenya Business Registration Service.

We record your requests for information and any feedback we receive from you.

We obtain personal information from you when you use our website, enquire about our activities, register with us, send or receive an email, ask a question, or otherwise provide us with personal information.

We may also collect technical information relating to your use of our website, including your browser type and Internet Protocol (IP) address. We gather general information about the use of our website, such as which pages users visit most often and which services or content are of most interest, and may use this to improve our website. Wherever possible, this information is aggregated or anonymised.

We may also receive information about you from third parties, for example from our donors, funders and fundraising partners (such as the Wildlife Conservation Network), or from individuals or partner organisations who share our conservation interests and may introduce you to us.

Why do we collect this information?

We collect this information for the purpose of conducting and managing our conservation work in the Tsavo Conservation Area, including managing our staff and operational functions, our relationships with donors, and our fundraising activities.

We will only use your personal data when the law allows us to. Most commonly we rely on one or more of the following legal bases under the Kenya Data Protection Act, 2019:

• Consent, where you have given us clear consent to process your personal data for a specific purpose
• Contract, where the processing is necessary for the performance of a contract to which you are a party
• Legitimate interests, where processing is necessary for the legitimate interests pursued by Tsavo Trust or a third party, provided your interests and fundamental rights do not override those interests
• Legal obligation, where we are required to process your data to comply with the law

‘Legitimate interest’ means the interest of Tsavo Trust in conducting and managing our conservation work as effectively as possible. We consider and balance any potential impact on you before processing personal data on this basis.

We do not generally rely on consent as a legal basis for processing your personal data other than in relation to sending you direct fundraising or marketing communications by email or text message. You have the right to withdraw consent to marketing at any time by contacting us.

How do we use this information?

We will use your personal information:

• To promote the charitable and conservation aims of Tsavo Trust
• To provide you with the information you have requested
• To provide you with information about future events, campaigns and projects that we think may be of interest to you
• To make suggestions and recommendations about our work that may interest you

Additional uses of data received from donors and fundraising partners

Information provided to us by our donors and fundraising partners, such as the Wildlife Conservation Network, may include a profile of your interests and preferences, based on WCN’s analysis, so that we can contact you in the most appropriate way and with the most relevant information. This helps us understand your interests, how you engage with us, and what level of support it might be appropriate for us to ask you for.

Do we share your information with anyone else?

We share your personal information with:

• Government agencies and authorities, including the Kenya Wildlife Service (KWS), the Wildlife Research and Training Institute (WRTI) and county governments (such as Makueni County Government), in the course of our collaborative conservation and community work, under memoranda of understanding, and where required by law
• Our donors, funders, grant-makers and fundraising partners, including intermediaries such as the Wildlife Conservation Network (through which US-based supporters can give) and a wide range of other conservation funders, for the purposes of processing donations, reporting on the work they support, and carrying out due diligence
• The Kenya Revenue Authority, tax authorities, regulators and other authorities where we are required to do so by law
• Conservation and community partner organisations that share our aims, including the community conservancies we work with, where there is a legitimate reason to share

We may share your personal information with third parties for marketing purposes only in accordance with your preferences. If you do not want us to share your personal data with any third party for marketing purposes, please contact us at info@tsavotrust.org.

We may share your information with contractors and suppliers who provide services on our behalf, to the extent necessary to enable them to provide those services.

If you make a payment or donation to us, we will share your information with our payment processor. By paying via our payment processor you agree to accept their terms and conditions, including their privacy policy. We suggest you read that privacy policy before donating.

We may also disclose your information where required to do so by law or as expressly permitted under applicable data protection legislation.

Our website may, from time to time, contain links to and from the websites of our partner organisations, funders and affiliates. These websites have their own privacy policies. We do not accept responsibility or liability for those policies and encourage you to review them before submitting any personal data.

International transfers

As part of receiving support from donors based outside Kenya (particularly through Wildlife Conservation Network in the United States), transferring personal data internationally may be required. Where we transfer personal data outside Kenya, we ensure that appropriate safeguards are in place in accordance with the Kenya Data Protection Act, 2019, including through contractual arrangements or by transferring only to jurisdictions that provide an adequate level of data protection.

How long do we keep your information?

We keep your information for no longer than is necessary. We will retain your information for any period required by law, for example to comply with the requirements of the Kenya Revenue Authority. Where we are not under a legal obligation to retain your information, we will determine what is necessary by reference to the lawful basis for processing and our legitimate interests.

How do we protect your personal information?

We take appropriate technical and organisational measures to ensure that the information disclosed to us is kept secure, accurate and up-to-date, and retained only for as long as necessary for the purposes for which it is used.

We use secure services when you make a donation through our website, operated via a virtual gateway. Our online payment systems are Payment Card Industry Data Security Standard (PCI DSS) compliant.

You should be aware that the use of the internet is not entirely secure. Although we will do our best to protect your personal data, we cannot guarantee the security or integrity of any personal information which is transferred from you or to you via the internet. Any transmission is at your own risk. Once received, we will use strict procedures and security features to try to prevent unauthorised access.

Film crews, photographers, journalists and researchers wishing to feature Tsavo Trust’s work should contact us to put an appropriate filming, photography or data-sharing agreement in place before using our content or accessing our sites.
